Since I'm sleepy but yet can't find the right position and be asleep, might as well i put some thoughts in this place. Few months ago there's an uprising of 'anti-racism' movement going on in my batch, or more like anti bumiputera status. People started posting anti-racism status, videos of racism in Malaysia, and even more after the Interlok issue, these things keep on coming like hot banana fritters. Everyone seemed to be the expert or at least a victim of the 'racism'. Posting status and videos which shouted,"im a victim of racism! please pity on me" is becoming the trend.<br />However, my mind keeps on thinking again and again trying to recall back what i learn from History subject during my SPM years. The social contract and all are now slowly forgotten and started to be put aside in the name of 'unity' or oneness. I dont blame them for trying to fight for their 'right'. The governing race of Malaysia should be put to blame. I know helping your own race is a good thing but helping them TOO much when sometimes they don't deserve to be helped is another matter. In the 1960s when Harimau Malaya was feared by neighbouring countries, we had all sort of race playing in the team. Malay,Chinese,Indian,Singh,Iban...u name it..they were all represented. But now? I remember watching the triumph of Harimau Malaya against Garuda team late 2010. The victory which our country sought after for so long, a victory of which they say finally football has come back here, won by a team formed 95% by Malay and coached by an Indian. Why is that? Where have the others gone? Shouldn't we learn from history that united we are strong? When in the 1960s, we WERE strong. But trying to hold on to the 'Malay Supremacy' just pure stupid. But I also believe that it is not just the fault of the governing race. The politician of the other races should be blame as well. Playing on the racism cards for the sake of power, didn't we learn anything from 13 May?<br />About the bumiputera status, for what its worth, i stil strongly believe it should be there as long as the other races are allowed to keep their own school and languages. And i believe that IF the other races still want equality, so be it. Let there be ONE language, ONE school. No more sitting with chinese or indian and felt left out because they are talking in their own world. WE can be like Indonesia then, where every race is the same. But the question is, would the other races agree to abolish all those Sekolah Jenis Kebangsaan and usage of their mother tongue from any official occasions? No more Tamil news, no more Chinese news, just Malaysian news in BAHASA MALAYSIA? hows that sound? to me that is the only fair justification if the bumiputera status to be abolished, because by doing so all the other races will focus more on MALAYSIA instead of coming back to their root. but somehow i feel malaysians are not ready for this. Won't count much...nobodyhttp://www.blogger.com/profile/07345493601285788931noreply@blogger.com2tag:blogger.com,1999:blog-4255858975436058281.post-32094026763926170742010-11-29T09:34:00.000-08:002010-11-29T09:54:52.672-08:00Just something that popped in my mind..General election is coming soon.....seeing all the by-elections trend, somehow we can predict the outcome of this coming general election...<br />Anyway, i read somewhere that some of the people in Malaysia wanted to make the age limit of putting out a vote is 18 years old...currently it is 21 years old...maybe some parties thought that by giving power to the younger ones, they might actually win an election...might be true, for one semester only..when they grow up(if they grow up) they will know the lies and games of politicians..i remember the war cry used by the Americans to change their age limit to 18, "if ur old enough to die for ur country, ur old enough to vote for ur leader"<br />its catchy, nice and somehow patriotic....but i like to put it this way,"if ur old enough to pay ur own taxes, ur old enough to vote who will spend the money" :D<br />i prefer dat the age limit of voting is set when an individual starts paying taxes...means they actually do something productive in the country rather than live as a parasite..just my idea though..a hell lot of people will be against it for sure...because a lot of people do nothing but want a hand in the vote...<br />hmm...i always wonder, what democracy really is...and after living for 22 years on this earth, i realised that its something like this....its about majority...the majority will choose a leader, and the leader will serve the majority....thats democracy...but doesnt sound fair is it? what about the minority?<br />nowadays its kinda a hot issue in my place about the minority being oppressed..and if ur reading up till now u'll know what 'minority' i meant here...well, considering we're leaving in a democratic country, i guess they just have to live with it? haha! sounds bad is it...but that's the ugly truth...painful aite? the majority chooses the leader to help the majority...the leader cant please everyone, especially the minority..why? because if he does, next election he wont get the majority votes...<br />ive thought of somehow a way to decrease this discrepency in democracy...why dun a vote is considered in percentage rather than a single count...and that percentage is based on the amount of tax the said voters paid...means that, the higher the amount of tax one pays, the higher his vote percentage, means his vote alone maybe count up to 4-5 person...to me its fairer than this old school single count vote..since the minority here always claim that they are the one who brings modernisation in Malaysia, means that they are the ones who are in the higher socioeconomic groups..which means they pay more tax...or is it? haha! anyway, this system might be better than what we are using now...no more racial slur...its all about productivity...if u provide more for the country, the more power u have in choosing ur leader...those who dun do anything, well...just sit tight and see what the future holds for u.. :p i hope some politicians will read this and take this idea into account..im sick of hearing minorities saying they are oppressed eventhough they are commited in the upbringing of the country..this system will show it all...who does and who doesnt..<br />hmm...talking about oppressed minorities, i wonder who is the richest man in malaysia right now...i wonder whether all of the things these minorities said about being oppressed by the majorities are true, or is it that they are being oppressed by their own kind...hmmmmmnobodyhttp://www.blogger.com/profile/07345493601285788931noreply@blogger.com0tag:blogger.com,1999:blog-4255858975436058281.post-81016396392678360292010-11-15T05:10:00.000-08:002010-11-15T05:16:25.509-08:00this is malaysiaGuy A : My dad wants to buy a new car<br />Guy B : What car? recognised the unsung heroes...to them,what they dont know is not true and not good...they rarely appreciate whats in front of them unless that thing is already gone....<br />i want to share a story of a man...he is raised by a businessman father and a mother who used to be a local entertainer...like any other boys,he IS naughty..but as he grows up,he started to have the feelings of responsibility towards his younger sister...many times he picked up a fight with other boys who tried to disturb his sisters...when he started secondary school,he followed in his father footsteps in his father's business,making ice cream cone...he worked hard as he thought that would be what he'll be doing later on in his life.....he tried saving some money from his father business but later his father found out about it and took the money away....his father,although a good businessman,a strict father who raised his child with discipline,is an addict gambler...he took the money the man saved for the future of the business for his usual activites...and one unfortunate day, he lost it all....lost everything on a gambling table...the man,dissappointed with what happened,quit working with his father and join the police...he started from the lowest rank,joining the force since the year 1970s....he doesnt have any certificate or diploma with him when he joined...just secondary school....during his time at the force,his wife persuaded him in taking classes in order to get some paper and move higher in the ranks....the wife sacrficed her time to be the only one who raised their 3 children while the man went on to classes after work has finished.....if there is no class,then its work 24/7....after getting his diploma, he continued taking degree....the wife continued taking care of the three child....after promoted to the rank of asp,he is transferred away from his birthplace,a place where none of his siblings have lived before....he have to leave behind his old mother and bring his young family with him...his workload increases...day and night,working here and there,risking his life at times to provide food on the table for his wife and children...he rarely sees his own children.....but to him,it is the main objectives for him to provide first before being there for them...the wife will take care of the rest....after few years, he continued his study in a master degree and is further promoted....but life never really changed....he is still busy....weekdays and weekend are all the same for his children...there're rarely family night out like all their friends family...the children grew up....went to universities far away from the homeland....and only that when the children are already far away,he is promoted to a higher rank and is less busy but he still left his wife 2-3 days a week alone in the house for work...sometimes outstationed to foreign countries up to a year...<br />this story is a typical story about a policeman life.....the man is my dad,and i really look up to him...every night when he goes to work, i would always hope i can see him again the next morning....thats how i feel...everytime i read the newspaper, looking at the criminals and how prudent they can be now,i just hope my dad would retire and work something else...but he wont...."i still love the force",he always said to me...not the salary,not the medal...his salary are just enough to bring up me and my 2 elder sisters..he's been there around 40 yrs now...moving here and there every 5-6 years...from kuching-klang-gombak-shah alam-bukit aman-phillipine-bukit aman-cheras...and some other places i dun know where he went to years before i was born..i can only look at the pictures of it...no one would write a book about it because no one would read it....unless he died in some kind of an incident...but whats the use of it? appreciation of something when it is not there...thats typical msian attitude...my dad used to told me stories about his work....breaking in to the al-Maunah hq in klang armed with only MP5 with no bullet proof vest....car chase with a trailer and some shot being fired....i wonder if in one of the stories, he got killed...will msian come to me as they come t0 Aminul Rashid's family??<br />no im not asking for stupid sympathy...im asking for conscience,and appreciation....while they are still there and alive....do msians have the consience of how much the police sacrificed their life so that we can sleep soundly at nite? by being free?<br />freedom always relates to harmony....and how do we achieve harmony? by restrictions we call rules and law....and how do we have freedom when we have restrictions?<br />because freedom doesnt mean we can practically do anything or everything without any consequences...and that is what most people misunderstood....<br />rules exists to limit those freedoms we rightfully own...why?<br />so that our freedom does not invade the freedom of others...we live in a small world...where we share almost everything....we share one God(for those who belief on monotheism)....of which is called on different names by different religion...and for Islam itself,there's 99 names...<br />but why do we quarrel upon one name? is it wrong to share?<br />thats where the problem lies...sharing.....<br />sharing is caring...yeah right<br />sharing with those of same objective or destination is a good thing to do....<br />sharing with those of different objectives, just for the sake of using some things that we do not own to make our journey easier is usually what we called a parasite....<br />let me give an easier example....<br />A owns a car....he goes to work to KL every morning...B doesnt own a car but also goes to work at the same place as A...so he share A's car every morning and pay half of the petrol...<br />but what if......<br />A owns a car..he goes to work to Kl every morning..C doesnt own a car but has more than enough money to buy his own car but doesnt want to buy...so he sticks with A every morning to go to work but he works at a different place which is not on the way to KL and A has to reroute everytime to send C to work and make A late for work...now this is what we called a parasite...<br /><br />the concept in this examples are to show whats happening now in malaysia....<br />Although the name Allah is not the property rights of Islam like the one in the example given,it is used by the religion for thousand of years without any disagreement by other religion....no war has occured before regarding the name used by Muslim to refer to their god....Christianity which exists long before the prophet Muhammad p.b.u.h was borned does not use the name Allah to refer to their god...even during the era of pagan Arab(pre-islamic)they believe in polytheism...and the name Allah was not used(correct me if im wrong with facts).....Christian refers their god as The Holy Father for the non-trinitarian, Jesus Christ as the Saviour and Lord and Holy Spirit as the act of the Holy Father upon us...and the Trinity branch of Christian believes that this three being is actually one which they refer to as The Holy Trinity....<br />now.....the problem arises when a certain Christian sect in Malaysia wanted to refer their Holy Father as Allah and wanted to publish it in their Malay Bible...now,can u see the resemblance between the current situation and the example ive given? this two religion has two different belief...two different objectives....although the concept of monotheism remains the same, the whole other part of the religion is almost completely different....(dont give me rubbish as to say that all religion are the same in a way that they preach people doing good...the side objectives may be similiar but the core of the religion is different) now why now that they wanted to use the word Allah? everything has a reason....i dont want to judge anything i have no facts on but u can judge it by urselves.....<br />they are certain muslims which states that it is their right to call their God Allah as it is the same..it is one god..now, can they say that all religion that believes in monotheism is the same? can Allah be called the Holy Father? since the Holy Father can be called Allah...<br />this is just my 2 cents on the current ongoing situation in Malaysia...nobodyhttp://www.blogger.com/profile/07345493601285788931noreply@blogger.com0tag:blogger.com,1999:blog-4255858975436058281.post-29275335895494572272009-12-29T12:56:00.000-08:002009-12-29T13:17:00.298-08:002010Its been awhile now since i post anything in this blog...since im too 'busy' with real life and all...hehe<br />2010 is coming soon...leaving 2009 and the memories behind...this coming Saturday im having my 4th block exam...yeah,new year celebration in the exam hall....and a month after i'll be facing my university exam...it still feels like yesterday when i sat for my 1st year university exam....how time flies...but its different this time...my 2nd year sucks like shit...with my internals are all fucked up,i wonder how im going to pass this coming exam..hell no i dont want to repeat...i don't want to stay anymore in this place...but then im still blogging instead of reading through my notes...haha<br />so much to read,so little time and motivation....nowadays i always find myself idling in front of the laptop with nothing to do...will have to change though for this coming exam or i'll be shitting myself during the exam...<br />with this coming new year,i hope i'll pass my exams,got through into 3rd year, finish up my time here and go back to Malaysia for good...<br />Sometimes i wonder, how will i be doing later in life....what kind of a doctor i would be...no thanks i won't take such quiz in facebook to see whether im going to end up as a surgeon with hands of god or be in prison because i killed the prime minister mistress in a surgery...<br />Somehow i always feels like this examination system,how fair does it judge the students...some lucky bastard would be lucky enough that the part he read came out for the exam..some really hardworking students would fail his paper because he is sick or because he forget one organism while remembers all the other hundreds...i see a lot of my friends,some of which are really really REALLY hardworking that i thought it is unfair for them to fail...but then again,who am i to judge whats fair and whats not....thats just my humble opinion...examination system doesnt always produce the best student...it may also discard the best student themselves.....its quite tragic though,to see such hardworking students,failed their exam,and have to repeat the academic year...yes they say God works in a mysterious way....i couldnt help myself to question his decision sometimes...for example,in Islam it is said that non believers will be condemn forever in hell....what about those borned as non muslim...how would this be just for them? when we looked back into history,several incidence has occured upon that race..may it be nature wise or human wise...nature itself has tried to eliminate that particular race...man himself also tried to eliminate that particular race but to no avail...why? i can sum it up in a simple situation...a kid brought an extra sandwich to class...he gave it to one of his classmate of which he wanted to borrow his class notes....thats how simple politic is...its abt building relation with people...but knowing the evil nature in human, they manipulate politic to be something lower than filth itself..some people do politic for money, some for power, some for their own personal objectives..it could be anything,from good to bad...sometimes it can be seen as using people to get what you wanted...and some people are very good at it,they can make the people they use unaware that they are being used....<br />lets take a look at a smaller scope,my college....haha..politics are everywhere,even on college level...being on good terms with the lecturers might gives u the edge if you ever listed for the viva...or if you skip class, you can still get the attendance by giving some reasons as long as you are in good terms with the lecturer...some of my collegemate use their knowledge to be their political edge..knowledge in religion,in technology..anything will do to gain support of people, or to put up their name so that people will see that their exist...and it irks me when this kind of people(status craze people) when they start abusing their knowledge to gain a higher status in the society....well,everything must start somewhere,and at last these people,my collegemates whom will grow up and be the one leading the country,brought along these kind of politic into the country political scene....<br />and the result? is like what we've seen now...power craze here and there....using all kind of tricks,personality assasination....yes,im really against personality assasination...for example,you are fighting against another candidate for another party...you try to win the crowd not by winning their hearts, but by 'killing' the other candidate so that you will be the only candidate...how to kill? they look up your personal history,from the day you are born till the day you've become their enemy....every single thing will be put up, even how long it takes for you to stop urinating on bed...anything will do to put you down,and it will always succeed...why? because no human is perfect..<br /><br /><br />thats enough about politic,what im interested to say today is about tahajjud....LITERALLY means to struggle rid oneself from sleep...just now,there was a small misunderstanding between my batchmates about the way it is done...though RARELY did it...hehe...but this is the result of my research and i found out,mostly in Quranic verses, they act is done after one sleeps,though it is not wrong to do it without sleeping..so in the end it still depends on our purpose(niat) right?<br /><br /><span style="font-style: italic; color: rgb(51, 204, 0);font-family:Verdana,Arial,Helvetica,sans-serif;" >Allah Most High said, “Establish worship at the going down of the sun until the dark of the night, and (the recital of) the Qur’an at dawn. Lo! (the recital of) the Qur’an at dawn is ever witnessed. And some part of the night awake for its recital, as voluntary worship for you. It may be that your Lord will raise you to a praised estate.” [Qur’an, 17: 78-79] </span><br /><br />From this it can be seen that some part of night we are required to be awake,meaning that we sleep before that and some part means later in the night...<br /><br /><span style="font-family:Verdana,Arial,Helvetica,sans-serif;"><i> <span style="color: rgb(51, 204, 0);">‘They forsake their beds to cry unto their Lord in fear and hope, and spend of what We have bestowed on them. No soul knows what is kept hid from them of joy, as a reward for what they used to do.’</span></i><span style="font-style: italic; color: rgb(51, 204, 0);"> [Qur’an, 32: 16-17] </span></span><br /><br />from this it can be seen that,they forsake their bed,meaning they give up their bed or they wake up to do something....<br /><br />and this is from ijma' ulama'...<br /><br /><p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">1. The minimal night vigil prayer is 2 rakats. [Hindiyya, quoting <i>Fath al-Qadir</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">2. Its optimal recommended amount is 8 rakats, because this was the general practice of the Messenger of Allah (blessings and peace be upon him, his family, and companions). [Hindiyya, quoting <i>Fath al-Qadir</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">3. Lengthier recitation is superior to a larger number of rakats prayed. [<i>Durr al-Mukhtar, Radd al-Muhtar</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">4. If one divides the night in thirds, then the final middle third is most virtuous. [<i>Durr al-Mukhtar</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">5. If one divides the night in half, then the second half is more virtuous. [ibid.] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">6. Voluntary (<i>nafl</i>) prayer at night is more virtuous than voluntary prayer during the day. However, the full reward mentioned in the Qur’anic verses and Prophetic hadiths refers to worship that was preceded by sleep. This is also understood from the very linguistic meaning of <i>tahajjud</i>, which is to struggle rid oneself of sleep. [Ibn Abidin, <i>Radd al-Muhtar</i>, quoting Ibn Amir Haajj’s <i>Halba</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">7. Ibn Nujaym and Haskafi both affirmed that night prayer is recommended. [al-Bahr al-Ra’iq, and al-Durr al-Mukhtar; chosen in al-Fatawa al-Hindiyya] Kamal ibn al-Humam, the brilliant mujtahid who was the greatest Hanafi faqih of the latter half of Islamic history, however, wavered between it being recommended or a confirmed sunna. This is because while the spoken hadiths indicate recommendation, the continued practice of the Prophet Muhammad (Allah bless him and give him peace) would seem to indicate it being a confirmed sunna. This was also chosen by Ibn al-Humam’s student, Ibn Amir Haaj in his Halba. [Ibn Abidin, <i>Radd al-Muhtar</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">8. Do not be like so-and-so. He used to pray at night and then left it.” [Bukhari and Muslim] Therefore, one should take on an amount of works one can sustain, for the Messenger of Allah (blessings and peace be upon him, his family, and companions) said, “The most beloved of actions to Allah are the most constant, even if little.” [Bukhari and Muslim] [Ibn Abidin, <i>Radd al-Muhtar</i>, from Ibn Amir Haajj’s <i>Halba</i>] </span></p> <p><span style="font-family:Verdana,Arial,Helvetica,sans-serif;">9. It is recommended to start the night vigil with two short rakats, because of the hadith of Abu Hurayra that the Prophet Muhammad (Allah bless him and give him peace) said, “It you get up for night prayer, start with two short rakats.” [Muslim, Ahmad, Abu Dawud]<br /></span></p><p>from this it can be seen that it is adviced to do the tahajjud later in the night,not early in the night...anyway,to those who cant accept ijma' from ulama'....i cant say anything more to you..to me,these ulama' has studied the literal and figurative meanings of the dalil and hadith and we who are only mere medic student with no sufficient knowledge of hadith,quranic verses,hukums, have no right to make our on decision on such things..yes,Syafie once said if you find a hadith or quranic verses contradicting him, follow the quran and hadith...but how do we interpret the dalil? is what we interpret right? don't you think Syafie or the other imams has not seen the dalil and interpret it before they lay out their opinions? to me,those words from Syafie are directed to those who live a life of studying this field only,who expertise are parallel to them or at least has sufficient knowledge about these...for us who make these things our side interest,(we didnt study this things like we study for our block exams right?) we're just simply not competent enough...its like when somebody who has never been to a medical school but wanted to give out a medical certificate...its just not right isn't it? Ini juga di antara perkara yang sering dibincangkan oleh masyarakat sekarang. Pada zaman wujudnya ulama terdahulu, perkara sebegini tidaklah menjadi masalah. Malah para sahabat baginda sallallahu alaihi wasallam yang tidak sampai ilmunya ke tahap ijtihad maka mereka juga mengikut para sahabat yang lain yang sampai ke tahap tersebut tanpa berlaku perbalahan. Tetapi yang menjadi keajaiban bagi kita pada zaman yang penuh dengan kekurangan ilmu pengetahuan walaupun hebat dan canggih dalam teknologi, boleh timbul permasalahan sebegini. Mengapa boleh berlaku sebegini? Jawapannya mudah, kerana sudah tidak yakin dengan para ulama terdahulu dan merasakan diri sudah layak sebaris dengan para ulama mujtahid.Malah dipandang rendah kepada golongan yang bertaqlid kepada sesuatu mazhab.</p> <p>Sebelum melangkah lebih jauh, sebaiknya kita terangkan apakah yang dimaksudkan dengan taqlid. Taqlid menurut ahli bahasa ialah ikatan yang diikat pada tengkuk. Manakala menurut istilah para ulama Usul Fiqh , terdapat dua maksud padanya:</p> <blockquote><p><strong>Pertama:</strong> Taqlid ialah beramal dengan pendapat seseorang dengan keadaan pendapat tersebut tidak dibinakan di atas hujah-hujah yang diletakkan oleh syarak. Ini tidaklah dibenarkan oleh syarak untuk mengikutinya.</p> <p><strong>Kedua:</strong> Taqlid ialah beramal dengan pendapat ulama mujtahid tanpa kita mengetahui sumber pengambilan dalilnya secara lengkap dan terperinci. Ini sangat-sangat dituntut oleh syarak malah diwajibkan kepada sesiapa yang tidak mampu untuk mencari semua dalil.</p></blockquote> <p>Menurut Syeikh al-Allamah Ali Jumaah hafizahullah di dalam kitabnya البيان : <strong>Apa yang kita maksudkan dengan ((tanpa mengetahui sumber pengambilan secara lengkap dan terperinci))</strong> ialah <strong>mengetahui cara-cara untuk mengeluarkan (mengistinbatkan) secara jelas hukum-hakam tersebut seperti yang dilakukan oleh mujtahid</strong>.<span id="more-633"></span></p> <p>Siapakah mujtahid? Apakah syarat-syarat untuk meletakkan seseorang tersebut sebagai mujtahid? Di antara <strong>syarat-syarat mujtahid</strong> ialah:</p> <blockquote><p>1. <strong>Mengetahui secara terperinci hukum-hakam fiqhiyyah</strong> sama ada hukum-hakam yang telah diterangkan di dalam kitab-kitab fiqh, mengetahui dalil-dalilnya seperti yang diterangkan di dalam kitab usul fiqh, mengetahui juga tentang khilaf(perbezaan pendapat) yang berlaku di dalam masalah furu’(cabang ilmu) di antara para sahabat atau tabi’en dan mengetahui juga berkenaan dengan pendapat yang dipegang di dalam mazhab.</p> <p>2. <strong>Seorang mujtahid perlu menguasai dan memiliki perkara-perkara yang diperlukan untuk mengeluarkan hukum</strong>. Al-Imam Ibn Qawan al-Syafie rahimahullah (889H) menyebutkan di dalam kitabnya التحقيقات في شرح الورقات : Antara perkara yang perlu dikuasai oleh seorang mujtahid ialah<strong> ilmu nahu(tatabahasa arab),ilmu bahasa arab(makna bagi sesuatu bahasa) , termasuk ilmu balaghah (bayan, badi’e dan ma’ani)</strong>. Al-Imam al-Syatibi rahimahullah lebih berat di dalam meletakkan syarat-syarat sebegini.Menurutnya, <strong>seseorang mujtahid tersebut perlulah menguasai ilmu nahu seumpama Sibawaih (ulama yang pakar dalam ilmu nahu suatu ketika dahulu) dan mengetahui tentang khilaf ulama seumpama al-Imam Syafie radhiyallahu anhu</strong>. Jika kita ingin mengikut pendapat yang disebutkan oleh al-Imam Syatibi rahimahullah maka sudah tentu amat sukar untuk kita temui mujtahid pada masa sekarang.</p> <p>3. <strong>Seorang mujtahid juga perlu menguasai ilmu Rijal(ilmu tentang perawi hadis)</strong>. Maksudnya mengetahui martabat seorang perawi tersebut sama ada boleh digunakan untuk berhujah atau tidak. Menurut Imam Ibn Qawan rahimahullah, <strong>jika seseorang tersebut hanya berpandukan tentang sahih atau tidak sesebuah hadis tersebut berdasarkan apa yang ditetapkan oleh al-Imam Bukhari, Muslim dan lain-lain ulama hadis maka ia juga dikira bertaqlid kepada para imam tersebut</strong>. Sedangkan para mujtahid dilarang mengikut pendapat orang lain di dalam masalah ini. Jadi perlulah mereka juga untuk menguasai ilmu ini dengan mengkaji sendiri masalah tersebut.</p> <p>4. <strong>Mestilah seorang mujtahid tersebut menguasai ilmu berkenaan tafsir al-Quran dan ilmu-ilmu berkaitan dengannya</strong>. Seperti mengetahui tentang<strong> Nasikh dan Mansukh, Mantuq dan Mafhum, Khas dan Am , Mubayyan dan Mujmal, Muqayyad dan Mutlaq.</strong> Mereka juga perlu <strong>menguasai ilmu asbab nuzul (sebab penurunan ayat) dan asbab wurud (sebab dilafazkan hadis)</strong>.</p></blockquote> <p>Jika kita perhatikan syarat-syarat mujtahid yang diletakkan oleh para ulama, maka tentu kita boleh berfikir dengan waras dan menilai kemampuan diri kita sendiri. Menurut Syeikh al-Allamah Atiyyah Saqr rahimahullah, jika seseorang tersebut mampu untuk<strong> mencari dan mengeluarkan dalil dengan sendiri</strong> (berdasarkan syarat yang telah diletakkan) maka<strong> tidak perlulah baginya untuk mengikut mana-mana mazhab</strong>. Malah <strong>haram</strong> baginya mengikut mazhab yang lain.</p> <p>Persoalannya, <strong>adakah kita telah sampai tahap tersebut?</strong> Jika telah sampai seperti yang diperolehi oleh al-Imam Abu Hanifah, Imam Malik, Imam Syafie, Imam Ahmad Bin Hambal , Abu Thaur, Sufyan al-Thauri, Sufyan bin Uyaynah, Daud al-Zhohiri, al-Auza’ie dan lain-lain maka silakan untuk berijtihad. Saya bukan mencabar, cuma mohon untuk menilai kemampuan diri kita. <strong>Ini kerana terlalu banyak orang yang mengaku tidak perlu untuk mengikut mazhab hanya kerana mendengar perkataan sebahagian guru-guru mereka yang belajar tanpa manhaj supaya tidak perlu mengikut mazhab dan boleh untuk berijtihad dengan hanya mempelajari kitab Subulussalam</strong>.Pelik kan? Tapi inilah hakikatnya sekarang bilamana seorang tersebut merasakan dirinya sudah sampai ke peringkat yang tertinggi.</p> <p>Syeikh al-Allamah Ali Jumaah hafizahullah ada menyebutkan beberapa tohmahan yang diberikan oleh golongan yang tidak mahu bermazhab.Antaranya ialah:</p> <p><strong>TOHMAHAN PERTAMA</strong></p> <p>Dalil yang wajib kita ikuti ialah al-Quran dan Sunnah bukannya pendapat para ulama mazhab.</p> <blockquote><p><strong>JAWAPAN</strong></p> <p>Apa yang disebutkan oleh golongan sebegini juga sebenarnya sudah menyalahi maksud sebenar dalil. <strong>Dalil bukanlah hanya semata-mata al-Quran dan Sunnah</strong>.</p> <p><strong>Ijma’, Qiyas, Istihsan, Uruf, dan lain-lain juga merupakan dalil yang digunakan oleh para ulama.</strong> Golongan yang memahami bahawa dalil hanyalah al-Quran dan Sunnah sebenarnya telah menyempitkan kefahaman tentang dalil itu sendiri. <strong>Al-Quran dan Sunnah adalah sumber pengambilan hukum yang dilakukan oleh seseorang mujtahid tersebut</strong>.</p> <p>Pendapat para <strong>ulama mazhab pula bukanlah menyalahi dan membelakangi al-Quran dan Sunnah itu sendiri, malah pendapat yang dikeluarkan oleh mereka merupakan hasil daripada kefahaman mereka tentang sesuatu ayat dan hadis tersebut.</strong> Berpegang dengan pendapat para ulama mazhab <strong>bukanlah bermaksud meninggalkan kalam Allah dan RasulNya</strong>, bahkan jika kita berpegang dengan pendapat para ulama mazhab maka secara langsung kita telah berpegang dengan al-Quran dan Sunnah. Ini kerana para ulama mazhab lebih mengetahui tentang syarat pengambilan hukum dan sebagainya berbanding kita.(saya cuma mengambil secara ringkas pendapat yang disebutkan oleh Syeikhuna Ali Jumaah hafizahullah. Pendapat yang saya letakkan disini rasanya sudah mencukupi bagi sesiapa yang mencari kebenaran.Jika ingin mengetahui kedudukan mujtahid maka perlulah melihat semula syarat-syarat mujtahid yang telah saya letakkan sebelum ini).</p></blockquote> <p><strong>TOHMAHAN KEDUA</strong></p> <p>Kami melihat seseorang yang bertaqlid kepada seorang imam tersebut tidak akan meninggalkan mazhabnya walaupun dia menjumpai sebuah hadis yang bersalahan dengan pendapat imam tersebut. Ini seolah-olah mendahului pendapat imam lebih daripada Allah dan RasulNya.</p> <blockquote><p><strong>JAWAPAN</strong></p> <p>Al-Imam Kairanawi rahimahullah menyebutkan di dalam kitabnya فو ائد في علوم الفقه :</p> <p><strong>“Pendapat sebegini keluar berdasarkan sangkaan kamu yang salah dan pegangan yang batil(iaitu mengatakan bahawa pendapat imam didahulukan berbanding kalam Allah dan RasulNya).Sedangkan perkara sebenar bukanlah seperti yang kamu fikirkan.”</strong></p> <p>Bilamana kita melihat berlakunya perbezaan di antara zahir kalam Allah dan RasulNya dengan pendapat Ulama Mazhab , dua perkara pokok yang penting perlu diperhatikan:</p> <p style="padding-left: 30px;"><strong>Pertama:</strong> Kita mengetahui tentang maksud sebenar kalam Allah dan RasulNya.</p> <p style="padding-left: 30px;"><strong>Kedua</strong>: Kita mengetahui bahawa Kalam Allah dan RasulNya bertentang dengan pendapat Imam Mazhab.</p> <p>Jika kita memerhatikan kedua-dua perkara di atas dengan teliti maka kita menyedari bahawa kedua-dua perkara tersebut <strong>tidak terdapat pada seorang Muqallid(orang yang mengikut mazhab dan tidak sampai kepada tahap mujtahid). </strong>Ini kerana ilmu sebegini memerlukan kepada pencarian dalil. Muqallid hakikatnya tidak mampu untuk melakukan sedemikian. Jika hakikatnya sedemikian, <strong>bagaimana mungkin seorang muqallid tersebut boleh menghukumkan bahawa Imamnya telah menyalahi hukumyang diletakkan Allah dan RasulNya?</strong>.</p> <p>Hasil perbincangan ini ialah:</p> <p>“Seorang muqallid tersebut tidak meninggalkan pendapat imamnya yang bersalahan dengan zahir Hadis dan sebagainya <strong>bukanlah kerana dia (muqallid) mengatakan bahawa pendapat Imam tersebut lebih benar daripada Kalam Allah dan RasulNya</strong>(tiada seorang ulama pun mengatakan sedemikian) bahkan hanyalah kerana <strong>dia sendiri tidak pasti adakah benar-benar Imam tersebut menyalahi Allah dan RasulNya</strong>( mustahil seorang Imam tersebut mengeluarkan sesuatu hukum dengan hawa nafsunya, melainkan setelah kajian terperinci dan syarat seorang mujtahid tersebut telah dipenuhi olehnya, barulah seorang Imam tersebut mengeluarkan pendapatnya).”</p></blockquote> <p><strong>TOHMAHAN KETIGA</strong></p> <p>Mengikut pendapat para ulama mazhab sendiri sebenarnya telah menyalahi apa yang ditunjukkan oleh mereka(Imam-imam mazhab).Mereka sendiri melarang mengikut pendapat mereka.Lebih-lebih lagi jika pendapat mereka bersalahan dengan hadis sahih.Jelas di sebut oleh para ulama Mazhab: إذا صح الحديث فهو مذهبي maksudnya: (Jika sah sesebuah hadis tersebut maka itulah mazhabku)</p> <blockquote><p><strong>JAWAPAN</strong></p> <p>Kata Syeikhuna Ali Jumaah hafizahullah:</p> <p style="padding-left: 30px;">Dakwaan yang mengatakan bahawa para ulama mazhab melarang untuk mengikut mazhab adalah satu dakwaan yang ternyata salah dan sesat. Tiada seorang ulama mazhab pun mengatakan sedemikian. Kalau mereka benar-benar mengatakan demikian,<strong> maka mengikut kepada pendapat Para Imam (supaya tidak bertaqlid dengan mereka) juga hakikatnya adalah taqlid itu sendiri( dalam keadaan tidak sedar)</strong>.</p> <p>Kamu mengatakan tidak boleh mengikut pendapat Imam Mazhab,tiba-tiba kamu mengikut juga salah satu pendapat mereka (iaitu supaya tidak bertaqlid-seperti yang kamu katakan) maka hakikatnya kamu juga bertaqlid.Bagaimana boleh dilarang taqlid sedangkan kamu sendiri bertaqlid dalam keadaan kamu tidak sedar?</p> <p>Ini jelas berlaku pertentangan di dalam pendapat kamu sendiri.(Sekejap mengatakan tidak boleh taqlid kemudian dalam masa yang sama kamu juga bertaqlid dengan pendapat Imam tersebut).<br />Kalaulah benar sekalipun dakwaan tersebut, maka sebenarnya larangan tersebut ditujukan kepada orang-orang yang telah sampai kepada peringkat ahli di dalam ijtihad(memenuhi syarat yang saya sebutkan sebelum ini).</p> <p>Berkenaan adakah boleh berpindah-pindah mazhab akan saya jawab pada keluaran akan datang. Allâh will have His Mercy on them. Surely Allâh is All-Mighty, All-Wise.</span></p><p>where it says all men and women(which in this case Muslims) are auliya' of one another...meaning we are friends to each other,protecting each other...or am i wrong? what about those politican who claimed this is an act of ethnic cleansing? and his parents who asked for justice...can the wrongdoings of his son be judged on them instead since they really wanted justice? yes....the same old stories,"BN party members joined PKR".....ok so what to be hyped about some people with no strong faith and own opinion to crossover into your party? As a commander you should know, if that person is able to betray his old leader,he will betray u too...its almost a year passed since the big win by BA and big lose by BN...and this coming 3 elections are for god sake are just by election...this power struggle are getting more ridiculous day by day....it started with the 16th Sept 08..then go on...and on...and the Perak drama....and on and on...and the Elizabeth Wong stories....and on and on.....and about the Elizabeth Wong stories....honestly on my opinion,she should accept and face the problem,not by running away,do it like Chua Soi Lek did...there's no reason for you to run away...what u did is what u did...no matter what religion u are,adultery is adultery...no matter u are married or not...this is no different case with Chua Soi Lek...either u are a Buddhist,Christian,Muslim,Hindus..i believe all religion are against adultery...and there are no place for atheist in Malaysia...so u have no exception...<br />It's been too long for this stupid power struggle to last...why don't they all just work together to face this economic letdown instead of buying or pulling members of opposite party to their own...<br />p/s: BA is being more like BN nowadays is it not?nobodyhttp://www.blogger.com/profile/07345493601285788931noreply@blogger.com0tag:blogger.com,1999:blog-4255858975436058281.post-86125940538140674832009-03-27T01:55:00.000-07:002009-03-27T07:04:37.129-07:00when your concern doesn't concerns meit's true when they say language shows what is us...how u talk,is how u project ur attitude towards other people...and i think its true to the extend that the language u use shows who u are...for instance,malay speaks malay...chinese speaks chinese,indian speaks indian...indonesian speaks indonesian...oh wait..why no malaysian? because they are no Malaysia...only chinese,indian and malay...i respect Tun Dr M's idea of having a Malaysian only....but well,all the races in Malaysia seems not in the same boat with him....when education is still separated, language is still a barrier there'll be slim chances of having a united one race only country...im not trying to be a racist here,but with all the non malays asking to have the same rights as the malay,i think that will be done only when we has the same chances of working in a computer shop where the ads doesn't say chinese are preferred or the ads are in mandarin all the way...<br />anyway,the topic of the day,or may i say what pisses me off today...is how the race thingy still a thick thing among us...just about an hour or two just now,my class had this voting for whether my batch are going to extend the holiday for this year's hari Raya or not...well,for a clearer picture,both my class reps are chinese...nvm that,i don't mind having a black,white,orange,green,yellow or anything to be at the helm as long as they do their work and care for the people under them..anyway,my class reps went to the Dean and ask him for the extension and the dean gave us 3 options,or so they said...<br /><br />1) 1 week extension(its 4 days only actually)<br />2) 2 days extension<br />3) no extension<br /><br />well..before we could cast our votes,the female class rep reads out all the advantages and disadvantages of our extension...and being a neutral,or so she said,she happily announce all the things which may be the consequences of our extension...if we take the 4 days extension, we are required to have classes on Saturday,our study break for unis will be cut down,our end of second year vacation will be cutdown and the Saturday class may last for a month or two......and for the 2 days extension,we might need Saturday class for 2 weeks....OK.......<br /><br />do the math..easy math first...<br />2 days extension=Saturday class for 2 weeks<br />4 days extension=cut down study break for unis,cut down end of second year vacation,Saturday<br /> class till a month or two....<br /><br />is it coherent???<br />and i thought 2x2=4......not 4 weeks Saturday class?<br /><br />ok,maybe a month or two Saturday classes to make up for the PBL,SDL and lab times...but cut down our holiday and the study break? i think its full of B***S***......<br />u see,3rd block is 10 weeks....4th block is 6 weeks...its 16 weeks...its 4 month...its 16 Saturday....do we need more then 16 days to cover back the 4 days we missed????????<br /><br />hmm...anyway,the result is 29 for 1 week,53 for 2 days and 48 for no extension...130 students voted..138 students total for my batch...<br /><br />77 malays<br />61 non malays<br /><br />82 vote for holiday<br />48 for no holiday<br />8 dont vote including the class reps who are supposedly neutral<br /><br />maybe there are people out there who cares and vote for our cause...but the way the reps and some of them react towards the cause irks me....<br /><br />i think the results speaks for itself isn't it....if its not my holiday,why should i care?nobodyhttp://www.blogger.com/profile/07345493601285788931noreply@blogger.com1
